The High Court of Justice, Osun State, sitting in the Ikire Judicial Division and presided over by Hon. Justice J. O. Owolawi, has delivered a landmark judgment in Suit No: HRE/M.15/2026, barring the Nigerian Police Force from further arresting, harassing, inviting, or threatening Senator Kamorudeen Olalere Oyewumi.

Delivering the judgment on June 23, 2026, the court held that the persistent threats of arrest, victimization, and incessant police invitations targeted at the Senator constitute a direct violation of his fundamental human rights guaranteed under Chapter IV of the 1999 Constitution of the Federal Republic of Nigeria (as amended) and Article 6 of the African Charter on Human and Peoples’ Rights.

The court action followed a Fundamental Rights Enforcement application brought through Senator Oyewumi’s legal counsel, I. T. Tewogbade Esq.

The Senator’s legal team argued that it has on good authority that the political opponents of their client have resorted to using police to continuously harass, intimidate and arrest Senator Oyewumi in Osun State in a deliberate effort to silence him, truncate his political activities, and undermine his mandate.

In his ruling, Hon. Justice J. O. Owolawi noted that despite being duly served with the court processes and hearing notices, the police authorities; including the Inspector General of Police, the Assistant Inspector General of Police (Zone XI), the Commissioner of Police (Osun State), and the Nigerian Police Force, failed to file any counter-affidavit to refute the claims. Consequently, the court deemed the credible and cogent facts deposed in the Senator’s affidavit as unchallenged and admitted under Nigerian law, resolving the sole issue for determination in favor of the Applicant.

In granting the prayers sought by the legal team, the High Court issued a formal declaration that the continuous acts of intimidation, incessant invitations, and threatened arrests against Senator Oyewumi are wrongful, unlawful, and unconstitutional. Furthermore, the court granted an order of perpetual injunction restraining the Nigerian Police Force, their agents, officers, and privies from further arresting, harassing, detaining, inviting, or curtailing the personal liberty and freedom of movement of Senator Oyewumi in any manner whatsoever.
